Agreement to Terms
By accessing or using the Employee Recognition Platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
These Terms apply to all users, including organization administrators, managers, and members. Your organization may have additional policies that also govern your use of the Service.
Definitions
- "Service" refers to the employee recognition and rewards platform provided through this website and associated applications.
- "Organization" refers to the company or entity that has registered for the Service and to which your account belongs.
- "User" or "you" refers to the individual accessing or using the Service.
- "Points" refers to the virtual currency used within the Service for recognition and rewards.
- "Recognition" refers to messages of appreciation with attached points sent between users.
Account Terms
Account Creation
- You must be invited by your organization or an administrator to create an account
- You must provide accurate and complete information during registration
- You must be at least 16 years old to use the Service
- One person may not maintain more than one account
Account Security
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized access or security breaches
- You are responsible for all activities that occur under your account
- We are not liable for any loss or damage from unauthorized account access
Acceptable Use
You Agree To
- Use the Service only for its intended purpose of employee recognition
- Treat other users with respect and professionalism
- Give recognition based on genuine appreciation and merit
- Comply with your organization's policies and guidelines
- Report any misuse or policy violations you observe
You Agree Not To
- Use the Service for harassment, discrimination, or bullying
- Post offensive, inappropriate, or discriminatory content
- Attempt to manipulate or game the recognition system
- Share your account credentials with others
- Attempt to access other users' accounts or private data
- Use automated systems or bots without authorization
- Circumvent security measures or exploit vulnerabilities
- Violate any applicable laws or regulations
Points and Rewards
Points System
- Points are allocated by your organization and have no cash value outside the Service
- Giving allowances are refreshed periodically as determined by your organization
- Points cannot be transferred to other users except through recognition
- Your organization may modify point allocations at any time
Rewards Redemption
- Rewards are subject to availability and may change without notice
- Redeemed rewards cannot be exchanged, returned, or converted back to points
- Gift cards and rewards are subject to the terms of the issuing merchant
- We are not responsible for expired, lost, or stolen reward codes
- Your organization may impose additional restrictions on reward redemptions
Points Expiration
Points may be subject to expiration as determined by your organization's policies. Unused giving allowances typically expire at the end of each allocation period and do not carry over.
User Content
Your Content
You retain ownership of content you create (recognition messages, comments, profile information). By posting content, you grant us a non-exclusive, worldwide license to use, display, and distribute your content within the Service for the purpose of operating and improving the platform.
Content Standards
All content must be appropriate for a professional workplace environment. We reserve the right to remove content that violates these Terms or is otherwise objectionable. Your organization's administrators may also moderate content within the platform.
Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time with or without notice. Scheduled maintenance will be communicated in advance when possible.
Account Termination
Termination by You
You may request account deletion through your profile settings or by contacting your organization administrator. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
Termination by Us
We may suspend or terminate your account for violations of these Terms, at the request of your organization, or for any other reason at our discretion. Your organization administrators may also deactivate your account.
Effect of Termination
Upon termination, your access to the Service will cease. Any unredeemed points will be forfeited. Historical recognition data may be retained for your organization's records, with your personal information anonymized.
Disclaimers
We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted.
Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for any claims arising from these Terms or the Service shall not exceed the amount paid by your organization for the Service in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless us and our affiliates, officers, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms, your use of the Service, or your violation of any rights of a third party.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which your organization is located, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of that jurisdiction.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and changing the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
